Public Law

This team acts in relation to judicial review, constitutional advice and applications, administrative tribunal work, and human rights matters. We are routinely instructed in judicial review matters by both decision-making bodies, including the Government of Bermuda, as well as persons aggrieved by decisions made by public authorities. Often these applications involve consideration of various constitutional provisions and our team is well versed in providing advice on the Constitution and its practical application in the day-to-day affairs of the Government and Bermuda at large. We are also experienced in dealing with planning law matters both on behalf of applicants and objectors. In the context of administrative law, we also routinely advise in relation to human rights matters and appear before the Human Rights Commission.

In public law matters, our clients and cases include: high level government employees involved in disciplinary proceedings, acting for the Government in relation to the Municipalities Act and issues relating to the municipalities, dealing with human rights complaints involving the Commissioner of Police, acting for Mailboxes Unlimited in relation to the interpretation of CPC4000, and drafting legislation and providing general advice in relation to the establishment of the Bermuda Tourism Authority.
